The National Prosecuting Authority (NPA) has dropped fraud charges against Pioneer Gas owner and socialite Genius Kadungure after the complainant withdrew the case citing an out of court settlement.
NPA’s head of commercial crimes Chris Mutangadura confirmed the latest development saying the state is no longer pursuing the case.Kadungure’s fraud trial which was scheduled to kick of this Tuesday (today) was aborted last minute after Wyclef Gatawa a Kadoma businessman and complainant in the matter notified the NPA he was withdrawing the charges as he had entered into a gentleman’s agreement and was settling the matter out of court.
The new development follows hot on the heels after a failed attempt to suck in Harare businessman Wicknell Chivayo into the saga when Kadungure’s lawyers wrote the NPA complaining on why Chivhayo had not been arrested and joined in the proceedings despite testimony that he was involved.

In the letter, Mpofu indicated that the Prosecutor General enjoys the discretionary powers to prosecute accused persons based on available evidence.
Mpofu summed up saying his client is an eminent businessman with an international reputation and does not involve himself in petty transactions.
The case was withdrawn from the court’s jurisdiction following the agreement by the involved parties to settle out of court.
