It is reported that Zakes Bantwini has made an application to the High Court to have his in a community of property matrimony with actress Nandi Madida dissolved.
Bantwini has been married to Nandi for four years and has petitioned to have his wife removed from their 5 million joint estates.
According to Zakes the pair mistakenly married in community of property due to a misunderstanding with their marriage officer.
“And as a result of a misunderstanding between ourselves and the marriage officer, who conducted the marriage ceremony, we understood incorrectly as it now appears that he would be in a position to ensure that our marriage would be out of community of property without the application of the accrual system.” Reads Bantwini’s affidavit seen by the Sunday publication.
It is alleged that Madida is not disputing the action taken by her husband.
She signed an affidavit declaring her agreement to amend their in community of property marriage.
Bantwini revealed that Nandi who is the face of Legit and Lux, does not have assets to her name.
Meanwhile, he owns a R3.4 million house in Morningside, KwaZulu Natal, and a R1.5 million crib in Modderfontein, Johannesburg.
He added that they would enter into a post-nuptial notarial contract and would not prefer the accrual system to apply because they individually have successful careers and independent sources of income.
Bantwini claims that the matter only occurred to him when they were discussing their personal financial affairs.
Although by law it is not allowed to execute an ante-nuptial contract after marriage it is possible to change your matrimonial property regime from in community of property to out of community of property with the permission of the High Court.
International Rapper and producer Dr Dre and former wife to be Nicole Young also recently found themselves in a similar situation. Theirs just a lot messier.
The pair found themselves in some sticky prenup drama when Nicole claimed that her soon to be former husband forced her into signing the prenup.
She filed for divorce in June 2020 requesting for spousal support and for the judge to divide their financial assests.
According to reports the rapper is worth over $800 million.
Dr Dre agreed to pay for spousal support but asked that their assets be divided as per prenuptial agreement.
Nicole who was married to the rapper for two decades claimed that not only was she forced into signing the prenup it was also torn up just a few years into their marriage.
An imbalance of financial being before marriage can be a difficult matter to work around. Many use a prenup as a protective mechanism to avoid potentially lengthy and painful court cases.
